Limitations of Warranty

• It is the users responsibility to determine the suitability of any Atlas Putty product for his intended use or particular production requirement.  Because the use of our products is beyond our control, we are not responsible for the results obtained.
• We make no warranties, expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose and undertake and accept no liabilities, except as expressly set forth on our product labels.  In every case, the Company's liability is limited to replacing such quantities of the product proven to be defective.  The Company disclaims any liability for reglazing, repainting, other labor or any consequential damages arising from the use of products.
• No representative of the Company is authorized to grant any warranty or to waive this limitation of liability.
• THE WARRANTY PROVIDED HEREIN AND THE OBLIGATION AND LIABILITIES OF SELLER THERE UNDER ARE EXCLUSIVE AND IN LIEU OR AND BUYER HEREBY WAIVES ALL OTHER REMEDIES, WARRANTIES, GUARANTEES OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION, ANY OBLIGATIONS OF THE SELLER WITH RESPECT TO CONSEQUENTIAL DAMAGES WHETHER OR NOT OCCASIONED BY SELLER'S NEGLIGENCES.  THIS WARRANTY SHALL NOT BE EXTENDED, ALTERED OR VARIED EXCEPT BY A WRITTEN INSTRUMENT SIGNED BY SELLER AND BUYER.

Ordering and Payment

• Net 30 days with approved credit, unless otherwise negotiated.
• Minimum billing of $50.00.
• No break on full cases.
• Prices subject to change without notice.
• All invoices will be subject to a charge or 1.5% per month (18% annum) or the maximum allowed by law if different, from the first day an invoice is past due together with expenses incidental to collection, including court costs and reasonable attorney's fees.

Shipment

• Orders on stock items will be shipped within 3-7 working days.
• Orders on Private Label or OEM goods with be shipped within negotiated terms.

Shelf Life

• One year minimum.  Products are coded using the Julian calendar date so that the retailer can rotate stock for optimal shelf life and customer satisfaction.  Example:  0311 signifies the 31st day of 2001.  We reserve the right to add a 15% restocking charge on returned merchandise.  No returns will be accepted without prior written authorization.
